Labor Law

Labor Law (also known as labor law or employment law) mediates the relationship between workers, employing entities, trade unions, and the government. Collective labor law relates to the tripartite relationship between employees, employers, and unions. Individual labor law concerns employees' rights at work and also through the contract for work.

Article 34(2) of the Constitution of Nepal 2072 says "Every laborer shall have the right to appropriate remuneration, facilities, and contributory Social Security."Article 43 of the Constitution of Nepal says "the indigent citizens, incapacitated and helps citizens, helpless citizens, helpless single women, citizens with disabilities, children, citizens who cannot take care themselves and citizens belonging to the tribes on the verge of extinction shall have the right to Social Security, in accordance with the law."

According to labor rules in Nepal, "No workers shall be employed to work more than 8 hours a day and 48 hours a week by an employer. Workers shall be provided with half an hour of rest after five hours of continuous work and in case of continuity, the time turn by turn should be provided. According to the labor act, No one shall be forcefully made a laborer, No child labor, Equality in work, maternal and parental holiday, bonuses, etc are the rights ensured by the labor act 2074 of Nepal.

Likewise, the minimum wage of workers in Nepal, according to the Ministry of Labour, Employment, and Social Security, which is effective from 1st Sharwan,2078 i.e. July 16, 2021, is at least Rs. 15,000 paid, and Provident Fund and Gratuity shall be added to it. And it will be reviewed after 2 years.

According to the Labor Act 2017 (2074), Provisions Relating to Employment
the different natures of employment are:-

 (1) An employer may engage a labor in any type of the following employment:

 (a) Regular employment,

(b) Work-based employment,

 (c) Time-based employment,

 (d) Casual employment,

(e) Part-time employment

*Trainee

*Outsourcing

*Hiring Foreign Nationals
