Social Media and Cybercrime Law in Nepal: Legal Provisions and Protection

The key legal framework is the Electronic Transactions Act, 2063 (2008) and accompanying cybercrime provisions, which criminalize acts such as hacking, identity theft, and publishing offensive or false content. Additionally, the proposed Information Technology Bill seeks to impose stricter regulations on online content, intermediary responsibilities, and user data. However, such measures have sparked debate, as critics argue they may restrict freedom of expression and press freedom.

  • Electronic Transactions Act, 2063, Section 47: Publishing illegal, immoral, hateful, or socially divisive content online may result in fines up to Rs. 100,000, imprisonment up to five years, or both. Repeat offenses carry heavier penalties.
  • Muluki Penal Code, 2074:
    • Sec 293: Prohibits recording private conversations without consent (up to two years’ imprisonment or Rs. 20,000 fine).
    • Sec 294: Forbids disclosure of confidential professional information without authorization (up to one year imprisonment or Rs. 10,000 fine).
    • Sec 295: Bans unauthorized photography or disfiguring images (up to two years’ imprisonment or Rs. 20,000 fine).
    • Sec 296: Restricts selling, publishing, or using photos without consent, especially for exploitation or gain (up to three years’ imprisonment or Rs. 30,000 fine).
    • Sec 297: Prohibits unauthorized opening of letters or tapping phone calls (up to two years’ imprisonment or Rs. 20,000 fine).
    • Sec 298 & 299: Outlaw breaches of privacy through electronic means, including unauthorized access, transfer, or sharing of electronic data (up to two years’ imprisonment or Rs. 20,000 fine).
